Acceptable Use Policy

This Acceptable Use Policy applies to your use of Pela's website, iOS app, and language-learning features, including AI tutoring, translation, camera OCR, and live multilingual communication services. It also contains terms governing disputes and limitations of liability for your use of the Services.
1. Purpose
Pela is designed to support language learning and communication. You may use the Services only for lawful, safe, and responsible purposes.
2. Your Responsibilities
You are responsible for:
- The content you submit or share through the Services.
- Following applicable laws and regulations.
- Using outputs with human judgment, especially in sensitive contexts.
- Protecting your account and device credentials.
3. Prohibited Uses
You may not use Pela to:
- Engage in illegal activity, fraud, scams, impersonation, or deception.
- Generate, promote, or distribute hateful, harassing, violent, or sexually exploitative content.
- Violate privacy rights, including doxxing, stalking, or unauthorized recording/surveillance.
- Infringe intellectual property or other rights of third parties.
- Upload malware, attempt unauthorized access, reverse engineer protected systems, or disrupt service availability.
- Use automation to scrape, overload, or abuse the platform beyond normal product use.
4. AI Output and Safety
AI-generated content may be inaccurate or incomplete. You must not rely on Pela output as a substitute for professional advice in legal, medical, financial, safety-critical, or emergency situations.
5. Minors and Sensitive Contexts
Do not use the Services in ways that exploit or endanger minors. If you use Pela in education or family settings, appropriate supervision is your responsibility.
6. Enforcement
We may investigate suspected violations and take action, including removing content, limiting features, suspending access, or terminating accounts where permitted by law. We may preserve, access, or disclose information where reasonably necessary to protect Pela, our users, or the public; investigate or prevent fraud, security, or other misuse; or comply with applicable law or valid legal process. Our handling of personal information and user content is described in the Privacy Policy.
7. Reporting Abuse
To report misuse, abuse, or safety concerns, contact support@pelapela.app.
8. Your Content
You retain any rights you have in content you submit to the Services. You grant Pela a non-exclusive, worldwide, royalty-free license to host, reproduce, process, transmit, and display that content only as necessary to operate, secure, support, and improve the Services, subject to the Privacy Policy and applicable law. You represent that you have the necessary rights and permissions to submit the content and that doing so does not violate law or another person's rights. Do not submit content that is confidential or highly sensitive unless you understand and accept the associated privacy and security risks.
9. Disclaimers and Limitation of Liability
THE SERVICES AND ALL AI-GENERATED OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PELA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUTS WILL BE COMPLETE, ACCURATE, OR SUITABLE FOR YOUR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PELA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PELA'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO PELA FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$100 IF YOU PAID NOTHING. THESE LIMITATIONS DO NOT EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
10. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Pela and its affiliates, officers, employees, agents, and service providers from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your unlawful use of the Services, your violation of this policy, or your infringement of another person's rights.
11. Informal Resolution and Binding Arbitration
Before either party starts arbitration, it must send the other written notice of the dispute and allow at least 60 days to try to resolve it informally. If a dispute arising out of or relating to the Services or this policy is not resolved, you and Pela agree to resolve it by final and binding individual arbitration before a neutral, independent arbitrator, rather than in court. The arbitrator may award the same individual relief available in court, subject to applicable law.
You and Pela each waive any right to a judge or jury trial and agree that disputes may be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. Where applicable law allows, either party may bring an eligible claim in small-claims court. Either party may also seek temporary or preliminary injunctive relief from a court to protect intellectual-property rights, account security, or prevent imminent harm pending arbitration. This arbitration provision is governed by the law applicable to your agreement with Pela and applies only to the extent enforceable; it does not limit any non-waivable consumer rights or rights to pursue a claim before a government agency where the law permits.
12. Governing Law and Severability
To the extent permitted by applicable law, this policy and any dispute not subject to arbitration are governed by the laws of the jurisdiction where Pela is established, without regard to conflict-of-law rules. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
13. Changes to This Policy
We may update this policy from time to time. Continued use after the updated policy is posted means the updated policy applies.
